Short-Term Rental Agreement

3. Payment

Full payment (rent, cleaning fee, and taxes) is due to confirm the reservation unless a written payment schedule is agreed. The refundable damage deposit of $500 (or an authorization hold on Guest's card) is collected before arrival and returned within fourteen (14) days after check-out, less any deductions under Section 5. Returned/declined payments and chargebacks initiated without cause are a material breach.

4. Cancellation

Cancellations 14+ days before check-in receive a full refund less payment-processing fees; 7–13 days, 50%; within 7 days, non-refundable. No refunds for early departure, late arrival, or no-shows. Host strongly recommends Guest purchase travel insurance.

5. Security deposit, damages & charges

Guest is responsible for the property and all occupants and visitors. Guest authorizes Host to charge Guest's payment method for: damage beyond normal wear; missing items; excessive cleaning; smoking or pets in the cabin; exceeding occupancy; violations of these rules; unpaid taxes/fees; and any third-party claims arising from Guest's stay. Guest will report any damage promptly. Deposit return does not waive Host's right to recover costs exceeding the deposit.

6. Occupancy

Maximum occupancy is the number listed for the cabin and is strictly enforced for septic, insurance, and safety reasons. Only registered guests may stay overnight. Misrepresenting guest count or hosting unregistered visitors is grounds for immediate termination without refund.

7. No pets · No smoking · No parties

Both cabins are strictly pet-free and smoke-free (including vaping and cannabis), inside and on decks. No parties, events, or gatherings beyond registered guests. Violations incur a minimum $500 remediation charge plus actual costs, and may end the stay immediately without refund.

8. Quiet hours & conduct

Quiet hours are 9:00 PM – 8:00 AM out of respect for neighbors. Guest will comply with all HOA, community, and local rules, and will not engage in illegal or disruptive activity. Repeated noise or law-enforcement contact is grounds for removal.

9. Assumption of risk & release of liability

Guest understands that use of the cabin and its features — including the hot tub, wood-burning fireplace, stairs, decks, fire pit, grill, the surrounding forest, wildlife, and terrain, and seasonal snow/ice — involves inherent risks. Guest voluntarily assumes all such risks for themselves and all occupants and guests, and releases, waives, and holds harmless the Host, owners, and their agents from any and all claims, injuries, illness, death, or property loss arising from the stay, except for the Host's gross negligence or willful misconduct. Children must be supervised at all times, especially around the hot tub and water.

10. Indemnification

Guest agrees to indemnify and defend the Host and owners against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from Guest's use of the property or breach of this Agreement.

11. Hot tub, fire safety & the cabin systems

Use the hot tub at your own risk; no glass, shower before use, and supervise children. Observe all fire restrictions in effect for the Prescott area and the Prescott National Forest — open flames and the fire pit may be prohibited during high fire danger; never leave fires unattended and fully extinguish them. The cabin is on a septic system: nothing but toilet paper down the toilets (no wipes, hygiene products, or grease). Do not feed or approach wildlife; secure food and trash.

12. Access, weather & roads

Mountain roads near Groom Creek can be steep and may be snow- or ice-covered in winter. Guest is responsible for arriving in a suitable vehicle and for safe travel. Host is not liable for inability to access the property due to weather or road conditions.

13. Right of entry & security

Host or its agents may enter for emergencies, repairs, or to address suspected rule violations. Any exterior security devices are disclosed; there are no cameras or recording devices inside the cabin.

14. License, not a tenancy

This Agreement creates a short-term, revocable license to occupy transient lodging for the dates above. It is not a residential lease and does not create tenancy or any rights under residential landlord-tenant law. Guest agrees to vacate at check-out, and Host may remove guests who breach this Agreement without formal eviction proceedings.

15. General

This Agreement is governed by the laws of the State of Arizona, with exclusive venue in Yavapai County. If any provision is unenforceable, the rest remains in effect. This is the entire agreement between the parties and supersedes prior communications. Guest consents to electronic signature and delivery. Host's maximum liability is limited to amounts paid for the stay.
